GENERAL TERMS AND CONDITIONS FOR ONLINE SALES

Before placing any order on the website www.veja-store.com ("Veja-store"), we invite you to carefully read the entirety of these General Terms and Conditions of Sale ("GTCS"). 

 

1. SCOPE OF APPLICATION 

 

1.1. These General Terms and Conditions apply to all sales contracts entered into between V Fair Trade (VEJA-STORE), a public limited company with registered office at Via Anhanguera, s/n, KM 26.5, Ed. Prédio 1, Sala 25, Jardim Jaragua, São Paulo – Brazil, registered with the National Registry of Legal Entities in Brazil under number 07.670.088/0005-21 ("VEJA"), and the user, considered a consumer, as defined by the Consumer Code, that is, any natural person who acts for purposes that do not fall within the scope of their commercial, industrial, artisanal, liberal or agricultural activity ("User", "you", "the customer") based on orders placed through Veja-store. 

 

1.2. By ordering products ("Products") from Veja-store, you accept and unconditionally agree to comply with the General Terms and Conditions. If you do not accept the General Terms and Conditions, you will not be able to place an order with Veja-store. 

 

2. CONDITIONS FOR PURCHASES ON VEJASTORE 

 

2.1. You may only purchase products on Veja-store if you are a user considered an end consumer. If you are a professional reseller or distributor, you will not be able to make purchases through Veja-store. For all users, VEJA reserves the right not to confirm, to refuse, to prohibit and/or to cancel orders in specific situations, such as item unavailability, inconsistencies in the information provided, suspected fraud, unusual orders or orders placed with the intent of resale. 

To ensure a better quality of service and availability of its Products for all users, VEJA reserves the right to limit the quantity of products that can be purchased by a single user. 

 

2.2. We limit purchases on our website to people who are at least 18 years old. By accepting these General Terms and Conditions, you represent and guarantee that you are at least 18 years old. VEJA is not responsible for any false statements regarding the age of users. 

 

2.3. We reserve the right to cancel or reject orders that appear to have been placed by professional resellers or distributors. 

 

3. VEJA'S ORDERING PROCESS 

 

You can place an order on Veja store either as a guest or by logging into your customer account. 

 

3.1. Placing an order as a guest 
Placing an order as a guest does not require creating an account. When selecting this option, the customer will be redirected to a form to fill in the necessary information to finalize and ship the order. If an existing customer account is identified with the same email address, logging into it will not be required. 

The customer can finalize their order as a guest, whether it's their first order or not. A confirmation email will be sent to the customer after the order is placed. The customer must create an account to track their order or request a return through the website.

All information regarding the guest order will be sent exclusively by email. It is important to check your inbox regularly and keep the emails you receive. 

Without a customer account, the customer will not be able to view this information in a customer space on the site, including the order details, order tracking, and the option to create a return slip if needed. 

 

3.2. Creating a customer account 

You can purchase products available on Veja-store by logging in with your credentials or using your Google or Apple account. 

To create a new Veja-store account, you must correctly fill in the fields on the registration form and choose a personal and confidential password. You must also confirm that you have read the privacy policy (insert URL here) available on the website. Subscribing to the newsletter is optional. 

After registering on Veja-store, you will receive a welcome email confirming the creation of your account, sent to the email address provided during registration. 

You can delete your account at any time by following these steps: 

My Account > "Personal Information" > "Delete my account". Upon receipt of the confirmation notification, any contractual relationship between you and VEJA — except for orders already placed before the deletion request — will be terminated, and your login credentials will be deleted. 

 

3.3. The order process 

The user selects the products of his choice and adds them to the cart via quick add or by clicking on "Add to cart". 

At any time, you can: 

  • Check the quantity of products in the cart, the price of the products and the total amount by clicking on the "Cart" icon.
  • Complete your order by clicking on the "Checkout" button. 

 

If you already have a customer account: 

You can log in after clicking on "Complete my order" by entering your email address and password. 

If you wish to place an order as a guest : 
After entering your email address, click "Continue as a guest" to proceed. 

You will then be asked to provide the delivery address for the products and select a delivery method from those listed in Clause 7. 

After this step, you will choose a payment method from those listed in Clause 5 and provide the billing address, if it is different from the delivery address. To finalize your online purchase, you must mandatorily provide your tax identification number (CPF) and your full address. You will then be able to click on "Complete and pay for my order". By placing your order, you automatically accept the General Terms and Conditions of Sale (GTC). 

At any time during these steps, your shopping cart details will be displayed. 

The sales contract between VEJA and you is concluded upon confirmation of your order. 

Between the time you make the payment and the sending of the "Order confirmed" email by VEJA, VEJA reserves the right to refuse the order in cases of: 

  • Existing chargebacks/disputes between you and VEJA;
  • Partial or total non-payment of one or more previous orders;
  • Refusal of payment authorization by banking institutions;
  • Stock availability problems;
  • Orders placed by professional resellers or distributors. 

 

Once your order is ready for shipment, you will receive a shipping confirmation email and the tracking code. 

In the event of product unavailability after your order has been placed, only the price and shipping of the available products will be charged. VEJA will inform you by email as soon as possible about the unavailability of the products, and the corresponding amount will be refunded using the same payment method used in the order. 

 

4. PRICES 

 

4.1. The prices of the products displayed depend on the country of delivery selected by the "User". 

 

4.2. The prices of the products do not include shipping costs, which are the responsibility of the user. Shipping fees are calculated after the final delivery address is provided and depend on the desired shipping option. 

 

4.3. VEJA reserves the right to modify the prices of the products and to adjust, limit or end any special offer, promotion or discount at any time. 

 

4.4. VEJA applies the current prices, as displayed on the website at the time of your order. We recommend that you always check the price before placing your order. 

 

5. PAYMENT METHODS 

 

5.1. VEJA uses payment service providers to process transactions made through the website. 

You can pay for your order using one of the following payment methods: 

  • Credit card: Visa, Mastercard, American Express, Elo
  • PIX
  • Apple Pay

 

5.2. Payment must be made at the time of ordering. 

5.3. Option to pay in up to 10 installments by credit card with a minimum installment of R$50.00, subject to the terms and conditions of the card issuer. In the event of cancellation or a full or partial refund of the order, the amount will be automatically refunded by the credit card issuer. 

5.4. We use industry-standard SSL (Secure Sockets Layer) technology to encrypt your payment data, such as your identity, address and credit card details.

6. CANCELLATION AND MODIFICATION OF AN ORDER 

 

6.1. Once the status of your order indicates "Payment Approved", you have up to four (4) hours to cancel it. You can cancel it directly on the order confirmation page or in your customer account, in the "My Orders" section. If the status of your order is different or if the four (4) hour period has passed, you will no longer be able to cancel it. 

 

6.2. Once the cancellation of the order has been processed by our services, please wait at least five (5) business days to receive the refund, depending on the processing time of your bank. If we are only able to process part of your order, payment will be taken for the entire order and, after the products have been shipped, a refund will be issued for the unavailable items. 

 

6.3. Once the order has been confirmed, it will no longer be possible to modify it. If you wish to change the order content, payment method or delivery address, you may cancel the order as explained in point 6.1 or return the products after receipt in accordance with the provisions of Article 8. You may also place a new order on the same day to receive the desired size or model. 

 

7. PRICE AND DELIVERY 

 

7.1. Delivery 

After confirmation of payment, we process and deliver your order to the carrier within an average of 24 to 48 business hours. 

Orders placed on Friday, Saturday, or Sunday are processed on Monday or on the next business day. 

Orders placed on public holidays are processed on the next business day. 

(Please note that delivery times and the processing of returns may be extended by 72 business hours during promotion or stock periods.) 

The following delivery methods are available and vary depending on the delivery status:

Once your order has been delivered to the carrier, you will be able to track the shipment of your package at any time using the tracking number provided by email or through your customer account. 

Once the order has been delivered to the carrier, the delivery of the products will be carried out in accordance with the carrier's delivery conditions. You will receive the necessary shipping information by email to check the delivery conditions, as well as the expected delivery date or deadline. 

 

7.2. Prices 

The applicable delivery rates are those mentioned on the website at the time of ordering, in the "Delivery" and "Returns" sections. 

 

8. RIGHT OF WITHDRAWAL, RETURN AND REFUND 

 

8.1. Right of Withdrawal 

In accordance with Article 49 of the Consumer Code, the Customer has a period of 7 (seven) days from receipt of the Order to exercise his/her right of withdrawal with VEJA, without the need for justification. 

In the case of an order consisting of several products delivered separately, the period begins from the receipt of the last product.

8.2. Return Rights 

Without prejudice to the legal right of withdrawal, and from the date of first presentation of the packaging, you have a period of thirty (30) days to return any product ordered that does not meet your needs. 

After this period, we do not accept returns of unwanted items. If you attempt to return it, we may be obliged to return the item and ask you to bear the shipping costs. 

 

8.3. Return Conditions 

All returned items must be sent in new, unused and unwashed condition. They must be returned in their original packaging whenever possible. 

Returned products that do not meet these conditions will be returned to you at your expense. 

 

8.4. Vouchers and Refunds 

 

Refunds can be issued : 

  • To the credit card used for payment.
  • As a store credit (valid for one year, only on the site), if the payment was made with a store credit.
  • To the original payment method if no credit card or store credit 

Provided that the return conditions are met, the processing time by our services is 7 business days from the receipt of the order in our warehouse. However, this time may be extended depending on your bank's processing time or if the return requires additional checks. 

Please note that : 

  • If the Order payment was made with store credit, the refund will be automatically issued as store credit. Store credits are valid for one year and cannot be refunded.
  • Exchanges are not possible. For a different size or model, we invite you to place a new order.
  • Products purchased on the Vejastore cannot be returned to a store. 

 

Following the Consumer Defense code, consumers have a 7-calendar-day period to withdraw from the purchase, starting from the receipt of the product or the signing of the contract (for services). This period starts from the day after delivery. To be eligible for a refund or an exchange voucher, products must be returned in their original condition and in proper working order, including packaging, accessories, instructions, and any other accompanying items. VEJA must fully reimburse the consumer (including initial delivery costs) within a reasonable period. The consumer has to contact the CX team to benefit from the total refund of his order. 

 

9. LEGAL GUARANTEE OF COMPLIANCE 

Products sold by VEJA STORE benefit from the legal warranty of ninety (90) days and from the legal protection against hidden defects, as provided under applicable law. 

The seller responsible for the legal guarantee provided under articles 18 to 26 of the Brazilian Consumer Defense Code is V Fair Trade SARL.

The guarantee excludes damages or defects that the consumer already knew or could not ignore at the time of purchase, those resulting from materials supplied by the consumer himself, as well as those caused by misuse, negligence, accident or unauthorized modification of the product. 

 

ATTENTION: 

Upon receipt at our Distribution Center, the product will undergo a quality inspection to verify the defect described in your exchange or return request. 

If the product does not present the reported defect or does not meet the conditions required for the requested exchange or return, we may return it to you. In such cases, shipping costs may be charged to you. 

If the product has undergone repair or maintenance carried out by a third party, warranty coverage may be refused where such intervention has caused the defect or prevents proper technical assessment of the product. 

To clarify what may or may not be considered a manufacturing defect: 

Considered a manufacturing defect: 

  • Detached, torn, burst, or broken parts;
  • A color shade different from the one purchased;
  • Glue residue;
  • Blurred, faulty, or peeling prints;
  • Frayed or defective laces. 

Not considered a manufacturing defect: 

  • Stains from dyes or other products that are not part of the footwear – It is recommended to avoid contact with dyed fabrics, as color migration between products may occur;
  • Scratches – Caused by friction and wear resulting from use;
  • Wear and tear – Caused by use of the product;
  • Yellowing rubber – As we do not use high levels of chemical additives in our materials, yellowing may occur naturally over time, since our rubber is native to the Amazon and rich in natural properties. In some of our products, this characteristic (a more yellowish sole) is inherent to the product;
  • Changes in product color due to sun exposure or improper washing – It is recommended to dry the product in the shade if necessary (please refer to the proper cleaning instructions for VEJA products);
  • Pen marks, cuts, or any intervention carried out on the product;
  • Odor;
  • Loss of product parts (laces/straps, insoles, etc.);
  • Discomfort – The experience of comfort is highly personal. Therefore, it is essential that when the customer first tries the product, they do so preferably wearing socks and testing it over a carpeted surface to prevent signs of use. If any discomfort is felt, an exchange or return should be requested immediately. 

In any case, if the products present any of the items mentioned above, they may still be submitted for analysis by VEJA’s technical team. 

The legal guarantee of conformity obliges the professional, if necessary, to provide all necessary updates to maintain the conformity of the goods. 

 

Under the applicable legal warranty, the consumer is entitled to request repair of the product at no cost. The supplier shall remedy the defect within thirty (30) days, in accordance with Article 18 of the Brazilian Consumer Defense Code. 

If the product is submitted for repair, the legal warranty period shall be suspended during the time necessary to complete the repair and shall resume upon redelivery of the product to the consumer. 

 

The consumer may obtain a reduction in the purchase price, keeping the goods or terminate the contract with a full refund upon return of the goods, if: 

  • The trader refuses to repair or replace the goods;
  • The repair or replacement of the goods takes more than thirty days;
  • The repair or replacement of the goods causes significant inconvenience to the consumer, in particular where the consumer permanently bears the costs of returning or removing the non-conforming goods, or where the consumer bears the costs of installing the repaired or replaced goods;
  • The non-conformity of the goods persists despite the seller's attempt to bring them into conformity. 

 

If the defect is not resolved within the time limit provided by applicable law, the consumer may request replacement, reimbursement, or a proportional price reduction. 

The consumer does not have the right to terminate the contract when the conformity defect does not affect the use, features, or safety of the product. 

Any period of immobilization of the good for repair or replacement suspends the guarantee, which will resume as soon as the good is delivered in a repairable condition.

You can also attach photos and/or videos. Our dedicated team will analyze your request and respond as soon as possible. 

 

These provisions do not exclude the right of withdrawal set out in Clause 8 of these terms.

12. APPLICABLE LAW AND COMPETENT JURISDICTION 

These General Terms and Conditions (GTC) are governed by and construed in accordance with Brazilian law. The competent court in the event of a dispute will be the defendant's domicile or, at the request of the plaintiff, the place of actual delivery of the Product. 

 

13. INTELLECTUAL PROPERTY 

All content on this website (including, but not limited to, illustrations, photographs, images, texts, data, names, trademarks and videos) is the exclusive property of VEJA, its contractors or partners. This content is governed by copyright, trademarks, foreign copyright laws and other intellectual property rights. 

Any reproduction of this content, in whole or in part, by any means, requires the prior written consent of VEJA. You may not attach or download content from the website without the written consent of VEJA. 

 

14. DISCLAIMER OF WARRANTY 

In accordance with Article 393 of the Brazilian Civil Code, VEJA shall not be held liable for delays or failures in performance resulting from force majeure or events beyond its reasonable control. 

The website is provided on an “as available” basis. VEJA may modify or update its content at any time without prior notice. 

VEJA makes reasonable efforts to ensure the accuracy, usability, and availability of the website. However, access may be temporarily interrupted due to maintenance, technical issues, internet network failures, force majeure events, or acts of third parties. 

Nothing in this section shall exclude or limit liability where such exclusion or limitation is not permitted under applicable law, including mandatory consumer protection provisions.

16. CHANGES TO THE TERMS AND CONDITIONS 

VEJA reserves the right to modify the Terms and Conditions at any time and without prior notice, if such changes are necessary to comply with new legal provisions, to adapt the Terms and Conditions to VEJA's sales procedures or for technical reasons. The applicable Terms and Conditions are those in force at the time the order is placed. Updated versions of the Terms and Conditions will be published progressively on Veja-store.
